Abstract

The family is the fundamental unit of Islamic society, and the significance of the family institution in social development is undeniable. A society with a strong foundation in the home is morally and culturally resilient because the environment and upbringing within a household leave a lasting impact on an individual's character. However, over the past 20 years, the institution of the family has gradually weakened. People residing in the same household have become deprived of their rights and responsibilities towards one another, and incidents of domestic violence have become common. Courts are burdened with cases involving physical, emotional, and mental abuse. The primary reason behind this deterioration is the disregard for Islamic laws and the lack of tolerance among individuals. Moreover, there is a lack of effective national measures to address these issues, resulting in their continuous escalation. In 2021, the Domestic Violence Bill was introduced in Pakistan after years of efforts. However, this bill has faced objections from scholars and religious sects due to several clauses. In this article, we will review the bill in light of Sharia principles.
