عورت کی دیت کا مسئلہ: ایک تحقیقی جائزہ
Abstract
In this treatise, a woman’s share of blood money is discussed in the light of Islamic sources such as Prophetic traditions, statements of the righteous predecessors (Salaf), the consensus of the Muslim Nation (Ijmā’), and Analogy (Qiyās). Moreover, it is emphasized that a woman has a half share in blood money just like she owns in inheritance and bears in witnessing, because not only does she receive a monetary share in form of Mahr (dowry) and expenditures to spend on herself and family (Nafqah), but is also free from any financial responsibility in any aspect. Therefore, those who think that half of the share for her is injustice on her behalf, are in grave error, because in determining relations based on suckling (Raḍā’ah) lineage (Nasab), she is preferred over her male counterpart and no one considers it to be a dishonor for the male gender, rather it is considered a remarkable way of attributing equal rights to each gender according to his or her capacity.
