Abstract

Imam Shukani is considered as one of the great jurisprudents of his time. He gave only the Holy Quran and the Sunnah as a reference in the interpretation of rulings. The evidence of his jurisprudential insight is his numerous scholarly services, among which Neil Al-Awtar and Al-Sail Al-Jarar are prominent. He also has many distinctions in jurisprudential issues as according to him, the opinions of scholars and jurists should be seen as an ijtihadi opinion and not as a Shariah argument. He says that one's opinion should be accepted or rejected only on the basis of argument, and should not be influenced by the plurality of opinions. One should always act with justice and avoid partiality. The relationship with the rulers should be developed only so that the people can be reformed through them and not only to achieve personal interests by being flattered. He says that as much as possible the apparent meaning of arguments should be adopted. Apart from this, if we talk about some jurisprudential distinctions of Imam Shukani, then one of them is that the carcasses of animals that do not have blood are impure. No distribution of impurity is also proven in Shariah. Apart from water, purification can also be achieved with other items. A person who abandons prayer is a disbeliever and is obliged to kill. Jihad is always obligatory on every Muslim. It is not permissible to sell excess water, even if someone has stored it. The right of intercession is available only to the neighbor who is also on the way. So, some important distinctions of Imam Showkani are being discussed in this paper.
