Conflict between tradition and modernity in jurisprudential interpretations; A specific study of the "Problem of Awl".
Abstract
Traditionalism and modernism are two contrasting ideologies that significantly impact various aspects of human life, including the realm of Islamic law (fiqh). Traditionalism entails a profound reverence for traditional and religious values, while modernism rejects established norms and places greater emphasis on individual experiences. The clash between these two ideologies becomes apparent in several areas of Islamic fiqh, one of which is the concept of 'Aloul' in inheritance. While all Islamic scholars agree on the legality of 'Aloul' in Islam, Mr. Javed Ahmad Ghamidi holds the view that it contradicts the Quranic perspective. This research aims to explore and critique Ghamidi's concept, shedding light on the differences between traditional Islamic perspectives and the modernist interpretation advocated by Ghamidi.
